1. Introduction & Agreement

Welcome to Junovy. These Terms of Service ("Terms") govern your use of our website https://junovy.com and any services provided by Junovy.

Junovy provides the following services:

• Web hosting and managed cloud infrastructure
• DevOps consulting and infrastructure setup
• Fullstack web and application development
• Technical consulting and support
• Junovy Business Suite (Cloud Storage, Team Chat, Talk, Office, Sites, Money, Goals)

Specific service terms, deliverables, timelines, and pricing are defined in individual project agreements or service contracts between Junovy and the client.

3. Website Use

You may use our website for lawful purposes only. You agree not to:

• Use the website in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to our systems or networks
• Transmit malware, spam, or other harmful content
• Interfere with the proper functioning of the website
• Scrape, copy, or reproduce website content without permission

We reserve the right to restrict or terminate access to the website for any user who violates these Terms.

4. Intellectual Property

All content on this website—including text, graphics, logos, images, and code—is the property of Junovy or its licensors and is protected by Dutch and international copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent.

For client projects: Intellectual property ownership and licensing terms are specified in individual project agreements.

5. Client Agreements

These website Terms of Service are separate from any service agreement, statement of work, or contract entered into for specific projects or ongoing services.

In case of conflict between these Terms and a signed client agreement, the client agreement prevails.

6. Quotes & Proposals

Quotes and proposals provided by Junovy are valid for 30 days unless otherwise specified. Prices are exclusive of VAT (BTW) unless stated otherwise. Final pricing is confirmed upon signing a project agreement.

7. Hosting Services - Acceptable Use

This section applies to clients using Junovy's web hosting and infrastructure services.

7.1 Lawful Use Only

You may only use our hosting services for lawful purposes. We only accept customers who agree to use our services in compliance with applicable laws. You agree not to use our services to store, distribute, or transmit any content that:

• Violates any applicable law or regulation
• Infringes intellectual property rights of third parties
• Contains malware, viruses, or malicious code
• Facilitates fraud, phishing, or deceptive practices
• Constitutes illegal pornography or exploitation material
• Promotes violence, terrorism, or hate speech
• Violates export control or sanctions regulations

7.2 Right to Remove Content and Terminate Services

Junovy reserves the right to:

• Suspend or terminate hosting services immediately if we reasonably believe content or activity violates this Acceptable Use Policy or applicable law
• Remove or disable access to illegal or infringing content without prior notice
• Report illegal activity to relevant authorities
• Cooperate with law enforcement investigations as required by law

7.3 Automated File Scanning

All files uploaded to Junovy Business Suite services are automatically scanned for malware using ClamAV, a signature-based antivirus engine. This scanning is performed to protect the security of the platform and all users.

By using our services, you acknowledge and agree that:

• All uploaded files are subject to automated malware scanning
• Scanning is signature-based only; we do not analyse, classify, or profile file contents
• Files identified as containing malware will be quarantined and you will be notified
• Quarantined files are automatically deleted after 30 days unless a successful appeal is made
• You may appeal false positives by contacting security@junovy.com within 30 days

7.4 Notice-and-Takedown

In compliance with the Digital Services Act (EU) 2022/2065, Junovy operates a notice-and-takedown procedure for reporting illegal content hosted on our platform. If you believe content hosted on our services is illegal, you may submit a report following the procedure described at Notice and Takedown.

7.5 Customer Responsibility

You are solely responsible for all content hosted on your account and for ensuring compliance with applicable laws. We do not actively monitor hosted content but will act upon valid complaints, automated scanning results, or when violations come to our attention.

8. Limitation of Liability

To the fullest extent permitted by Dutch law:

• Junovy provides this website "as is" without warranties of any kind, express or implied
• Junovy is not liable for indirect, incidental, special, or consequential damages arising from your use of the website
• Our total liability for any claim related to the website shall not exceed EUR100

For services provided under a client agreement, liability terms are defined in that agreement.

9. Indemnification

You agree to indemnify and hold harmless Junovy, its owner, and affiliates from any claims, damages, losses, or expenses arising from:

• Your use of the website
• Your violation of these Terms
• Your violation of any third-party rights

10. Third-Party Links

Our website may contain links to third-party websites. Junovy is not responsible for the content, privacy practices, or availability of external sites. Accessing third-party links is at your own risk.

11. Availability & Modifications

We strive to keep the website available and up to date, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the website at any time without notice.

We reserve the right to update these Terms at any time. Changes take effect upon posting. Continued use of the website after changes constitutes acceptance of the revised Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of The Netherlands.

Any disputes arising from these Terms or your use of the website shall be submitted to the competent court in Amsterdam, The Netherlands.

Before initiating legal proceedings, we encourage you to contact us to resolve disputes amicably.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
